§ 3.01. Number, selection and term.

  • The legislative and governing body of the city shall consist of a mayor and six councilmen, and shall be known as the council of the City of Silsbee.

    (a)

    The mayor and two (2) councilmembers shall be elected at-large, the two (2) at-large councilmembers being elected to a specific place on the city council by number. Four (4) districts are to be established by the city council, and one (1) councilmember is to be elected from each of such districts by the voters of the district in which the candidate resides.

    (b)

    The mayor shall be the presiding officer of the city council and shall be recognized as the head of the city government for all purposes and by the

    governor for purposes of military law, but shall have no regular administrative duties. On all matters under consideration by the city council, the mayor shall be entitled to a vote only in the case of a tie.

    (c)

    In each even-numbered year, one (1) at-large councilmember (place 1) and two (2) district councilmembers (districts A and B) shall be elected. In each odd-numbered year, the remaining at-large councilmember (place 2) and two (2) district councilmembers (districts C and D) and a mayor shall be elected.

    (d)

    The mayor and each councilman shall hold office for a period of two years and until his successor is elected and qualified. All elections shall be held in the manner provided in Article V of this charter.

    (e)

    Upon adoption of this amendment, notwithstanding anything hereinabove to the contrary, the two (2) at-large councilmembers (places 1 and 2), and four (4) district councilmembers (districts A, B, C and D) shall be elected in 1986. The councilmember elected to place 2, and the councilmembers elected to districts C and D shall each serve for a term of one (1) year. Thereafter, all councilmembers shall be elected in accordance with section 3.01(c) of Article 3 of this charter. All incumbent councilmembers, excluding the mayor, shall serve out their terms to 1986 and the incumbent mayor shall serve out his term to 1987.
